Probably not the courts:

"Prescriptive easements for view, or the right to prevent a neighboring property owner from blocking the view across the property from a neighboring property, are not recognized in any U.S. state. This type of easement is referred to as "ancient lights" in some non-U.S. jurisdictions."

Ron, not to challenge your position but to the best of my memory to palms have only been there perhaps at most for 1-year. The problem I see is that they are distracting and takes away from the view. There are people in the areas of Wyatt, Hubbard and other streets whose views are interrupted. In fact, I am aware of one such property that lost out on a sale because thou advertised "with Water view" the client laughed and because of the palms didn't purchase. If the precedent is set with the palms, then who is to say that someone couldn't build a wall the next time to block our views.

Just a thought!

The Town ordinance has no such jurisdition-these have been in place for a few years so it would be difficult, if not impossible to ask that they be removed.  Speaking personally, not as Mayor, I am reluctant to see any laws passed that have to do with determining what looks nice and what doesn't.  It opens the door to the government determining a standard of esthetics...a standard I would not want put on me.

Bowers a city ?

Lived there in the 70's and visit time and time , where are the big business ? buildings , strip malls ect.... Have they pop up in the last month

Ron, Did the permit specifically address the size, shape color, etc. of the trees or was it general in nature? Can't imagine these hideous comic insults being approved in their present state.

Can the permit be overturned or challenged in any way?

Thanks for your reply and I am excited to know that a new energy has been created since your election. Just your reply alone is more than many would have expected in years past. The task of being mayor and the task Bowers is faced with to improve isn't an easy one. The climb to the top is always difficult but the view breathtaking.  Best of luck!

What is the process for getting rid of the Florescent Orange Palm trees?

I quite agree….our base line is here…our mission should be to raise the bar.

 

I have served on Town Council for almost two years and since 2005 have attended almost all council meetings.  Up until August of this year, participation in these meetings by the Town people was almost negligible.  There were usually the same five or six people in attendance…dedicated people who I thank for their interest and the help they gave me. 

 

I took office as Mayor of the Town of Bowers in August of this year.  I agreed to run for Mayor this year on the stipulation that more than one hundred eligible voters sign a petition for me to run.  To the people who asked me over the time prior to my running, I repeated the same mantra…the Town will be what the people make it…I am not the “do all” “cure all” to everyone’s problems.  The Town will reflect the “vision” of those who want to participate and are willing to put in the time and effort necessary to bring their joint vision to fruition.  For that reason, the council, through resolution, has created five committees-Planning, Budget, Traffic Safety, Parks and Recreation, Streets and Storm Water Management.  Committees and their members do not fall under the same restrictions as Council and the Mayor-i.e. they do not need to be permanent residents and they can meet anytime.  The purpose of each committee is to address, research, and come up with solutions to problems that are put before their respective committees by the people of this Town.  Since August, there has been an increase in the number of regular meeting attendees to over twenty.  It is my hope this participation will continue to grow.   Again, I laud those who have made it their purpose to become involved.  No one, including the Mayor or Council, receives any compensation, but I can assure you they are all dedicated to improving the quality of the Town.

                                                                                 

Addressing the “vision” and “direction”, the Town Comprehensive plan was adopted in 1994 and never revised.  Beginning in 2007, I began revising the Comprehensive Plan in my capacity as Councilman, taking into account the change in demographics the Town has undergone over the past several years.  This Plan is a State requirement and I have been working with the State Planning Commission.  The Plan has undergone initial review and attorney review and is almost ready to be submitted.  I completed these revisions with little feedback from the populous because little was available.  Again, I laud those who participated.  The plan will be revised on a regular basis to reflect the changing vision, but at present, forms a baseline from which to go forward.

 

Addressing the houses…the Town’s Zoning Ordinance only addresses dimensional requirements, not structural integrity or life safety issues.  These fall under the County Ordinance and are enforced by the County.  Some residents have expressed an interest in creating ordinances for this and other issues and draft ordinances have already been prepared.  Other residents don’t want new ordinances.  Again, involvement in the process will decide what eventually evolves.  The specific house referred to was demolished through a private endeavor to upgrade the property, as have all of the upgrades to properties in the area over the last several years. 

 

Yes…there is a lot to do, but it is my hope and prayer that this Town regain the community spirit it had when I first started coming here over forty years ago and that with that spirit will come dedication to improvement and involvement on all levels.  I thank everyone for their concern and support and to all of those already involved….special thanks and blessings.

Bowers has so much more than the other waterfront communities north of Lewes. Charters, restaurant, bar, museum, fire house, boat docks, etc.Plus not to mention a lot of people who would like to see Bowers council develop a vision for the future.

We were born and survived these many years since being discovered in the late 1700's by fishing and the industry around the bay. But that is now all dead. Just ask Frenchie and the others who have lived and fished the area for so long. We, the city, need a new vision from which to start a rebirth. A rebirth that honors our history and not some unorganized misdirected floundering like a "fish out of water"!

Orange palm trees, beer cans, litter, dilapidated houses, speeding thru the streets aren't going the bring new energy to the city. Stop the comics, focus on history, the museum, building, codes, and community service. That's what will make Bowers an exciting place for future generations of family and friends.

Lets' get some direction!!!!

Bower's Beach aint so bad...You ever seen kitts hummock?  Now that place is a freakin dump!  I mean theres some nice houses there but that road leading in....thats a whole other story.   Just a bunch of nasty looking junked houses with a bunch of garbage in the yard and 'No Trespassing' signs.  Yeah, like I really want to go in your "yard" and come out needing a tetnus shot.
