This is a far cry from the court accepting and willing to hear the case.  Don't hold your breath on this.  Also remember that the Supreme Court is liberally biased and are unlikely to throw their guy out and create a Constitutional crisis over an unintended technicallity that the founding fathers never anticipated.  Who then would be sworn in as President?  Bush is explicitly excluded due to term limits.  The liberals would never allow John McCain.  Ron Paul would have no claim to the office since he was not even on all of the ballets.  Nancy Pelosi due to the sucession clause?

The idea behind the requirements for being naturally born was to avoid allegiances to other nations.  For the life of me I can't see where President-elect Obama would be unduely influenced by his absentee father that he had little to no relationship with.  Given that he was born in HI and there is documented proof of, that tells me that he will be the POTUS in January.

I think the Supreme Court also decided not to challenge the 44 million people that voted for Obama, who were all aware of his past and the question over the BC.

Now, let's spend our time and efforts on supporting this new President elect.  Positive vibes are much more rewarding than negative ones.  We've been immersed in the negative now for so long, lets start looking at the good that will come from this new President elect.  We've suffered enough.  He has revealed plans to rebuild our Country....that would be infrastructure, government and our lifestyles. 

According to the Governors of this Country, they want to rebuild also.  For every billion dollars of infrastructure money alloted to their State, 40,000 jobs will be created.  That's a positive vibe/message.  We need more to change our attitudes of fear and question.  We need confidence builders.

Not sure why this is so breaking.  I predicted it back on December 1st.  There is no Constitutional interpretation to be done on this subject.  the Supremem Court does not settle disputes only Constitutional irregularities or ambiguities

Obama headed to Hawaii to check that the forged birth certificate passes muster.

 

President-elect Barack Obama, returning to his home state of Hawaii for the holidays, plans a beachside vacation at one of Oahu's most exclusive properties, according to an islander involved in the planning.

Arrangements are being finalized for the Obamas and the families of two or three friends to stay at a Kailua beachfront location with three modern, multi-million-dollar homes. Each wraps around a lagoon-style swimming pool, with palm trees, grassy lawns and retractable glass walls for postcard views of the white sand and windsurfers.

Obama and his friends plan to rent the privately owned homes for several days including Christmas, said the islander, a Democratic activist who spoke Thursday night on condition of anonymity because he was not authorized to reveal the details.

The property is located across the island from metropolitan Honolulu, in a residential section of trendy Kailua. The 2.5-mile beach is popular with local families as well as tourists, and has been rated by travel magazines among the best beaches in the world.

The property also has a sweeping view of the Koolau Range, a lush, forested ridge that forms the backbone of East Oahu.

Obama's spokesman would not comment on his holiday travel plans.

Gov. Linda Lingle indicated this week that that Valerie Jarrett, a close Obama friend and adviser who is co-chair of his transition office, would accompany Obama to the islands. Lingle said she intended to meet with Jarrett.

The governor also invited Obama to meet with her, her spokesman said.

Obama was most recently in Hawaii in October to visit his ailing grandmother, Madelyn Dunham, who raised him for much of his youth. Dunham died Nov. 2 at the age of 86, two days before Obama won the presidency.

 








 




 


While in Hawaii Obama also is expected to pay tribute to his grandmother, who was cremated, with a private family ceremony.

ObamaCon has still not been legally elected President. That may occur on Dec. 15. It will be interesting to see if the lawsuits have any effect upon the Electors..........what if?

In a perfect world you would be correct about mediocrity but where every person gets to vote some times you have to band together to make sure the worst of 2 evils does not get elected.  That is much worse than the lesser of two evils.  Stand on principals but live in reality

jj.......after considerable thought on the issue of Obama being the legitimate president of the US I have to say that personally I don't accept that. THere are far too many questions and things to be considered, but if the Supreme Court refuses to take the case there really is no recourse. Acceptance or not, that will be decided by a political court.

If you are curious as to my feeling on this I will explain but when you accept mediocrity and the lesser of two evils you deserve nothing better.

Illegal deals in land has a long history in Arizona as you  know and the same names are nearly always in the background somewhere. Even the Az Land trust engages in deals that are not in the publics best interest.

20 years from now we'll probably hear the same names coming up here and there.

I guess this topic is the best one to place this article under.  Some may remember Stapley getting in trouble out here back in the 80's for improper land splits.  He got out of that one unscathed.  Wonder how this one will go.  I've known Don for over 30 years.  He and some other partners developed Val Vista Lakes, among other known sites.

Maricopa County Supervisor Don Stapley was indicted on 118 criminal counts including perjury and forgery for concealing millions of dollars worth of land deals he is legally required to disclose, according to charges announced late Tuesday.

Stapley is accused of hiding land deals in Maricopa and Pinal counties that span as far back as 1994, covering virtually his entire tenure on the board. Among the transactions singled out by prosecutors are a $10 million loan obtained by companies owned or controlled by Stapley, and land sales involving Conley Wolfswinkel, convicted in the early 1990’s of bank fraud.

Neither of those transactions was properly reported on personal financial disclosure statements Stapley is required to file annually with the Maricopa County Recorder, according to the charges.

Wolfswinkel, the patriarch of one of the East Valley’s biggest land-owning families, is not charged or accused of any wrongdoing in the indictment, which was announced at a 5 p.m. joint news conference with Sheriff Joe Arpaio and County Attorney Andrew Thomas.

“The investigation to date found Stapley failed to disclose multimillion-dollar parcels of land in Maricopa and Pinal County, hundreds of thousands of dollars in personal and business bank accounts, leadership positions in Arizona corporations, and many other financial holdings and dealings,” the statement issued by Thomas’ office states in characterizing the charges.

The news release also says the indictment of Stapley is the “culmination of the first phase of an investigation” that started in May by a joint task force between the county sheriff and attorney that focuses on cases involving public officials.

Stapley told the Tribune the charges are “baseless,” and that he has always obeyed state financial disclosure laws.

Stapley said he was notified of the indictment about 3:30 p.m. Tuesday — about 90 minutes before the news conference with Arpaio and Thomas began. Stapley has hired former state Attorney General Grant Woods as his attorney.

“I stand falsely accused of failure to disclose complete financial information,” Stapley said during a brief interview with the Tribune. “I’m shocked and disappointed that these accusations are being made.”

He later sent a written statement to the media in which he vowed to fight the charges.

“I cannot fathom where these accusations came from or what motivated them,” Stapley said in the written statement. “But if my integrity is being questioned, I assure you that I stand on my record of complete integrity and disclosure and will fight these allegations.”

State law requires all elected officials to disclose virtually all of their holdings so the public can identify potential conflicts of interest. However, the disclosure requirements are very broad. For instance, the $10 million loan cited by prosecutors would fall into the category of debts of more than $100,000 — the highest of three disclosure categories.

The indictment was issued by a grand jury Nov. 20, but not disclosed until Tuesday. Arpaio said the reason for the delay was that Stapley was out of the country and could not be served with the indictment.

Among the accusations leveled by prosecutors is that Stapley failed to properly disclose loans obtained by three companies he owned or controlled totaling approximately $10 million. Stapley personally guaranteed the loans when they were refinanced, according to the charges. He defaulted on one of the loans in 2008, according to prosecutors.

All three of the companies are listed in Stapley’s most recent financial disclosure statement. The statement does not indicate Stapley recently defaulted on any loans, which were used for two parcels of property.

Thomas said it does not appear that Stapley’s lapses were inadvertent.

Thomas specifically pointed to a business deal by Stapley in the purchase of two parcels of land owned by members of the Wolfswinkel family. The parcels were purchased in 2004 for a total of more than $2.3 million.

The county attorney said he presumes that Stapley hid that purchase because he did not want his constituents to know he was involved in a deal with a convicted felon.

Wolfswinkel was convicted in 1993 on federal fraud and conspiracy charges related to a check-kiting scheme involving nearly $200 million.

Lee Johnson, an attorney for Vanderbilt Farms and other companies owned by the Wolfswinkel family, said late Tuesday that he is familiar with two recent sales of property by a Wolfswinkel company to Arroyo Pacific Investments, Stapley’s company. One involved about 80 acres near Arizona Farms Road and the Hunt Highway; the other about 80 acres south of the town of Maricopa, Johnson said.

The transactions were all properly documented, he added.

“These transactions were documented by deeds in the county recorder’s office,” Johnson said. “We have always presumed Mr. Stapley complied with whatever disclosure obligations he had.”

Conley Wolfswinkel is a consultant to companies owned by his two sons and other family members, Johnson said.

The indictment also says that Stapley lied on a loan application by checking “no” when asked if any of his businesses had ever been involved in bankruptcy. But Thomas said Stapley was cited by the Arizona Department of Real Estate for failing to disclose on his application for a real estate broker’s license that his company, Val Vista Lakes, had filed for protection from creditors.

Thomas said nothing found so far suggests that Stapley used his position as a county supervisor for his own financial benefit. But he said the investigation is continuing.

Arpaio said additional charges could be filed against one or more county employees.

Arpaio said his investigators went to the offices of the clerk of the Board of Supervisors on May 27 asking for information about Stapley. The sheriff said the employees there were told not to disclose the request.

Yet the very next day, Arpaio said, Stapley filed amended financial disclosure forms.

The sheriff said charges may be filed if someone improperly leaked the information to the supervisor.

“You may say that’s just a coincidence,” Arpaio said. “I don’t think so.”

Thanks, gk, thanks for all of the things you have posted and thanks for your continued flow.  Some folks don't want to hear and some are certainly not listening. Stay the course, there is no conspiracy from the citizen's side.  We all better watch for what is to come from the government's side.  I don't agree with everything you have posted but I appreciate your time and research that goes into the material, as it does (can) make a person pause and think.  You're doing fine.

What if the Supreme Court does not take up the case?  Will it be over at that point for you?  Will you accept Obama as a legitimate leader of our country?

That would just fuel further conspiracy theories.  The CIA, FBI, DNC, corrunption in the HI Governor's office, NAACP, Rainbow Colition.    The list just goes on which is why these nut cases can't be reasoned with.  It is always there way or no way.  The rule of civility does not apply to them.  The rules of logic are equally ignored.

I do not know GK personally but based on his writings here it seems that he does not like anybody.  He finds fault at every turn.  Typically this is because they have a deep level of distrust due to an event in thier life.  I do not know what Gk suffers from or had happen in his life but these conspiracy websites thrive on this personality trait.  In no way can these people be reasoned with.  They are irrational in their quest to find evil everywhere.  They throw out common sense to pursue their theory which most often get disproven with time.

It is still scheduled to go before the US Supreme court for discussion. Until then it IS NOT a dead issue.

It has NOTHING to do with race. How long do we continue to throw the Constitution out of the window? 


The Judge dismissed Berg’s case and admonished the attorney for errors in several spots in the 34-page memorandum Berg submitted. I read where Bergs sources came from the "Rainbow Addition Newsletter", and from Inside Edition on tv and some other sources.  Great sources.

Donofrio's case against Obama will hit the Supreme Court first.  His first submission was thrown out by Justice Souters, so now he has reapplied and it will be given to Justice Clarence Thomas.  Thomas plans on hearing it on Dec. 5th., 2008....to decide the merits of the case.  Berg plans on going to the third circuit of Appeals first, then to the Supreme Court.  If Donofrio's case is thrown out again, you can bet Bergs will be too.

If it has nothing to do with race then what does it have to do with? It's been proven he is a natural born citizen, but you still want to believe he is not.  Why?   The President elect is a scholar in the Constitution. His IQ is 142, so he's no dummy.  He taught the Constitution for years at the Univ. of Chicago, and was President of the Harvard Law Review.  He knows our Constitution front and back.  And so does Biden.  He was also a Professor of the Constitution.

There is no Constitutional Crisis nor will there be.  He is not the anti-christ nor is the number 666 on his forehead.  He is an honest, Christian, intelligent man who seeks relief for us all.

I would be willing to bet (and I don't gamble often) that the Supreme Court will not even hear the case.  Any case can be filed to the Supreme Court but they don't have to hear it.  Very few cases are actually argued there.  Generally the courts will only take up a case if there is an element of Constitutional intrepretion.  The rulings are usually very narrow and the case is then sent back to a lower court.  The cases rarely get settled there.  Since the Constitution is very clear about the President's level of citizenship there is not much to rule upon for the Supreme Court as respects to Mr. Obama.  However the issue with John McCain may open up a level of interpretetion since he was not actually born in the Motherland but on a US Military base in the Panama Canal zone to parents on US military orders.

The chances of sucess before Inaguration Day is about the same as Ron Paul's chances of winning the election back in March.

Judge tosses lawsuit challenging Obama citizenship

PHILADELPHIA (AP) - A federal judge has dismissed a lawsuit challenging Barack Obama's qualifications to be president.

U.S. District Judge R. Barclay Surrick on Friday night rejected the suit by attorney Philip J. Berg, who alleged that Obama was not a U.S. citizen and therefore ineligible for the presidency. Berg claimed that Obama is either a citizen of his father's native Kenya or became a citizen of Indonesia after he moved there as a boy.

Obama was born in Hawaii to an American mother and a Kenyan father. His parents divorced and his mother married an Indonesian man.

Internet-fueled conspiracy theories question whether Obama is a "natural-born citizen" as required by the Constitution for a presidential candidate and whether he lost his citizenship while living abroad.

Surrick ruled that Berg lacked standing to bring the case, saying any harm from an allegedly ineligible candidate was "too vague and its effects too attenuated to confer standing on any and all voters.

 

Let's not create a backlash, but let us support this President we just elected.  Let us unite in our objectives of support and not create spite and anger.  History tells us that white supremacy dies hard in America and its proponents will not take America’s victory lying down. 

People of color have struggled for their self-evident equality and unalienable rights since the first  Blacks arrived on the shores of Jamestown, VA in August of 1619.  Those individuals were traded and or sold into servitude for food and other supplies.  Those days and that type of mentality should not exist in a civilized society and our forefathers made sure of that by promising this to us all.........

We are embarking on a new dawn of Leadership.  Let's give him our support.  Hop on board and spend your valuable time organizing our community thru your leadership, under his guidance instead of speculating where or not he is a citizen, when in fact it has been proven over and over again that he is.:)  Are you looking for something that will finally stick.  Why?  Do you not like him and if so, why?  Would you become an insurrector if asked, just to remove him from office?  Why after the election, do you still want him gone?

Too many already have him in their crosshairs.  Give him your support:)

jj, I agree that the order needs to come from the courts. But if the public is asking for the proof, then to me the courts have an obligation to the people to serve such an order. I did not vote for Obama nor McCain so I personally do not see this as a witch hunt. I see this as Constitutionally raised questions. It is my opinion that if there is even the slightest chance that he is not leagl to become the Pres. then an order should be issued ordering him or anyone to produce said documents.

For the simple reason, that no one in the past has been asked to provide such proof. The people are demanding this, so he should be forced to produce. Our Consitutution must be enforced.

This is not about race, religion. name or politics.. this is about our constitution. It may be all hogwash and then again, it may not be (who really knows one way or another for sure?). There is only one way to prove this. Provide the requested proof so we can move past this

Responding to nut case conspiracy theorists only gives them legitimacy.  If there was something to this there would have been a lawsuit brought forth by the Clinton's a long time ago.  Seeing as they are the dirtiest politcians out there and they never pulled this card out of a hat tells me there is nothing there.

I would also not release this information as you would not either.  You would hold up the same Constitution and claim you are not required to produce this birth certificate unless ordered from a court. 

Which Constitution do you want to throw away GK?  Yours or his?  Next you would challenge John McCain's status since he was actually born on a military base in the Canal Zone and not on the Mother Land.  Is this your master plan to get Ron Paul into office?  There is no end when you are such an angry man that hates everyone that holds or desires to hold power over you.  I would hate to be looking over my shoulder all the time knowing that the boogyman was just waiting to pounce.  It is a pathetic way to live out our lives.

Come on, you can't be serious with that question. It's impoprtant enough that the Supreme Court is looking at it. It's a Constitutional issue, not a ideology issue.

That darn document still gets in the way of keeping powers in check, the sooner we get rid of the Constitution the better.....right! Boy George did a hell of a job destroyng much of it, now OmamaCon take finish off the rest!

Well.....for the first couple weeks after the Bush-Gore election I was acting a little insane also, so I'll give you some time.  But he will be our President, and probably for 8 years, and the United States will go on just fine.

I don't remember anyone hating politicians as much until Clinton came along.  Then we felt we needed to get even and trashed Bush.  How about we call it even now, and stop with the anger and bitterness.  This way, when one of your guys takes over, we can do the same.

The is another side to everything. It's a simple thing to do, produce the certificate. There are numerous lawsuits pending, the Supreme Court is taking under discussion and as the last article says more lawsuits will be coming.

Obviously you are some kind of Obamacon stooge, or you wouldn't make such a silly statement! This is serious stuff, and you should understand that because he fails to produce a certificate, or his college entrance papers. It's serious enough that the Supreme Court is looking at it.

You'll have to do better than "get a grip."

A lawyer who is playing a key role in a California lawsuit urging officials to prevent the state's 55 Electoral College votes from being recorded for Barack Obama until questions about his citizenship are resolved says he's organizing plans to challenge, even after the inauguration, every order, every proposal, every piece of paperwork generated by Obama.

"We will file lawsuits on his actions, every time. As long as we have money , we will keep filing lawsuits until we get a decision as to his citizenship status," Gary Kreep, chief of the United States Justice Foundation, told WND today.

"We're already talking to groups who are willing to be plaintiffs," he said.

As WND reported, Kreep filed the California challenge with presidential candidate Alan Keyes as a plaintiff.

The complaint urges the California secretary of state to refuse to allow the state's 55 Electoral College votes to be cast until Obama's citizenship and related eligibility to hold office is resolved.

It is just one of more than a dozen legal challenges brought forward so far over Obama's citizenship. The cases all cite Obama's clouded history and the U.S. Constitution's requirement that a president be a "natural-born" citizen.
