All i'm saying, assuming we are talking about the same house jlsc, is that i drove to the home to count the number of courses of block. When i spoke to SCHOA, they invited me to do just that. 16 course would be way illegal and 9 or 10 ft as you stated would be off the charts.

So, when i drove all the way up to phase three looking for the property and finally found it, i got my big old butt out of the golf car and did just that. At the junction between the back fence that isn't stuccoed and the side that is, i could count ten row of block.

My only point was in response to your comments about 16 course and 9 or 10 feet high. While i get along well with the complinace officers, they have a job to do and as a member i expect them to do it. As we were rebuilding SCHOA we went to great lengths to construct an organization that was firm, fair and flexible. The history of the organization was one that was founded on those tenets and we literally battled over preserving them.

Why not report this to the County?  There is a code enforcement division and they do enforce but it takes time.

So I will let it pass, and have my own fence added onto in the rear as my lot slopes as well and have SHOA measure it from the inside and at the entrance gates where it is in compliance at 6 feet and raise mine, GRAY area of compliance I will say, just where do u measure the walls at and at what point is it illegal against CC&Rs.

My reading of the rules is NOT MORE THAN 6 FEET at all in total, or am I missing something special in the CC&Rs.

I should leave sleeping dogs lie, but i personally think SCHOA is doing an awesome job these days and need to clear some things up. I went by the property in question and counted the course of blocks. It's 10 high, not 16. There is an arch there but let me just say that was one of the points of contention a year and a half ago. Arches are fine as long as they aren't ridiculous looking. In most cases a nice arch with a good looking gate adds to the value of the property and the neighborhood.

And, i must say, this house and the improvements are gorgeous. One of the compliance officers went and met with the homes owner who was more than gracious about letting him come and measure from ground to wall top inside the fence. It was at six feet. Like in most properties, the lot slopes away from the house and the illusion is that it is higher from street level.

This one is a non starter for me gang. I know SCHOA has ample numbers of other fights over CC&R's they are taking on, but it is important to get the facts right when taking about these kinds of problems. Anyone interested can go count the blocks like i did, so hoepfully this one can be put to bed.

9. Wall and Fence Restrictions. No solid wall, fence or hedge


shall be erected or maintained nearer to the front lot line that the walls of


the dwelling erected on such lot except when hedge or fence is purely


decorative in nature and shall not exceed twenty-four inches in height. In


the case of any lots on which no residence has been erected, no solid


wall, fence or hedge shall be constructed or maintained closer than twenty


(20) feet to the front lot line of any lot. No side or rear fence or hedge and


no side or rear wall other than the wall of a building constructed on any


lots shall be more than six (6) feet in height, provided that on lots


bordering the golf courses, no fence, wall, rail or hedge shall be


constructed or maintained at a greater height than six (6) feet within


twenty-five (25) feet of the rear property li ne, with any portion thereof in


excess of three (3) feet in height limited to wrought iron construction with


posts of concrete block or similar material. Landscaping shall be planned


for lots bordering the golf course so as to avoid undue obstruction of the


view of the golf course from said lots.

Okay Dingy, you said it was a fence!  Do you know the difference?  I have seen many walls/fences higher than 6 feet.  Can you tell me where the compliance officers draw the line?

Yes it is a violation ding bat, walls cannot be any higher than 6 feet see what I mean you dont even know your own CC&Rs..

I wonder how long it takes for SCHOA and the attorneys to make a home owner come into compliance, I see it has now been over a month with this guys fence and he still has it up, will it take years to get it into compliance I wonder, and during that time is he being fined in anyway, just a question if anyone knows the answers.

You refer to Sun City government but there is no government other than Maricopa County.  The RCSC manages the recreation centers and SCHOA is obligated to enforce the Deed Restriction and Clarifications.  Both organizations are also bound to follow their respective governing documents.

In regard to Deed Restriction enforcement, sometimes it takes awhile to get an owner to comply.  As Mr. Pearson said, "The fact is, they can tell/ask residents to comply with the CC&R's but if they don't or won't the next step is legal action."

What are you talking about?  What is wrong with face to face?  By the way, the RCSC has nothing to do with SCHOA and Deed Enforcement.  SCHOA only acts with reports or complaints from home or condominium owners regarding Sun City deed violations.

You always have the option of going into the SCHOA office and reporting a possible CCR violation.  All of the Compliance officers are very easy to talk to!  Try it sometime.

One of the problems you sometimes have justlivin is that you are quick to judge without knowing all of the details or the facts. I have not seen the house but have talked to the Compliance officers at SCHOA and they are taking action on this property. The fact is, they can tell/ask residents to comply with the CC&R's but if they don't or won't the next step is legal action.

Fortunately there are other issues with this property and with a little luck it will not have to go to court. While i am no longer with SCHOA, i support their efforts and can tell all of you who flaunt the the CC&R's as unenforceable, you are dead wrong! SCHOA can and will take you to court and force you to live up to the conditions, covenants and restrictions you agreed to when you bought a property in Sun City.

After careful consideration, and thoughts about SC and it's SELECTIVE ways of enforcement and NON ENFORCEMENT and going against the articles of incorporation which mean nothing to certain aspects of Sun City government "RCSC" TO NAME A FEW, I did the right thing and filled out the violation form for the house on the corner of cherry tree lane that has just EXTENDED the block wall to 16 blocks high which equates to about 10.6 feet high, when the home was recently sold it had a 6 ft wall and it now matches the eves of the home which is way way outside the parameters of the CC&Rs of 6 ft  and it looks as if SCHOA does nothing as they are now getting ready to paint the newly stuccoed and extended block wall . I must say the designer gates and 13ft high arches are quite ,,, well distinguished. BUT AGAINST THE CC&RS....Shame on SCHOA i say for not enforcing the CC&Rs, why do they pick and choose what they want to enforce, guess this household has special powers and privileges,maybe a clothes line in the back yard or a shed will be next but what the heck, he got his wall so he can build a 8 ft shed and no one will see it let alone his clean clothes flying in the breeze on his no no yes yes clothes line..
