I will repeat this because it is fact:
Empathy is nothing to do with justice which is blind. After guilt or innocense is decided, the "mitigating circumstances" enter into consideration and empathy is a human emotion applied to fixing the sentence by a judge having in-common experiences. To apply empathy before the case was decided is biasing the decision towards guilt or innocense. Judge Sotomajor applies empathy before givng her decisions as to guilt or innocense (right or wrong as was the case of firemen denied the results of their promotion exam by their city). When Judge Sotomayor's decision was "over turned" her empathy was exposed to have gotten in the way of blind justice. She is therefore unfit to be elevated to the USSC in a position where there is no further appeals process.

I am not so certain that she lacks an understanding of the constitution as much as she believes that she is a better judge of the way things should be. THAT is the real problem with her being confirmed.

| On appeals, Judge Sotomayor was "over turned" for her lack of juris prudence. She lacks understanding of what the US Constitution holds as God given rights that are sacrosanct (chisled in stone). Her ethnic sympathies over ride what the law says and bounderies of what the law allows. Judge Sotomayor is an activist in chamging what the Constitution says. It is the underlying "liberal attitude" towards all laws EXCEPT what they feel is empathetic to their point of view by set by race, gender, political bent, and personal prejudices. This woman is not fit to sit on the US Supreme Court administering "justice" which is beyond appeal.

| Well, David, I don't think the Republicans and the others have tried 'unsuccessfully' to convince us that this woman is unsuited for the position. The majority of the country has serious reservations about her. That will not deter the Washington Democrats we have representing us from voting her onto the Supreme Court, however. Elections have consequences and she will be one of the more lasting ill effects of the 2008 election.

The Law and Judge Sotomayor

The recent hearings on Judge Sonia Sotomayor’s nomination to the Supreme Court highlight certain points of disagreement in the public discourse on the law. The Republican Senators have unsuccessfully spent most of their effort trying to convince us that she is personally unsuited for the post (she’s too aggressive with lawyers, too biased in her interpretation of the law). In contrast, the Democrats have spent most of their effort telling her story, and praising her qualifications. You’d think that the hearings hung on her personal qualifications. But if this were the case we wouldn’t have had such a struggle. She is far and away the most qualified candidate for the Supreme Court that has been nominated in my lifetime. What is really at stake is an understanding of what the law is, and an unwillingness to seriously examine who benefits from its enactment.
Everyone knows that it makes a difference how the law is interpreted — all the difference in the world. Conservatives are inclined to believe that the law is clearly set forth in documents such as the Constitution, and resist what they call "activist judges" who do not enforce the law as the Constitution or the Congress intended. The theory goes that it is the role of the Congress to pass laws and the role of judges to enforce them. An activist judge imposes her own perspective on the process. In conservative thinking, the ideal situation is the objective law and an impartial judge interpreting it. The contradiction implied in the word "interpret" is glossed over. People who view the law this way are, generally speaking, those who have benefited most from its implementation. As the French philosopher Anatole France observed, "The law in its majesty prohibits the rich as well as the poor from sleeping under the bridges of Paris."
Now, we all know that judges do not rule alike even though they interpret the same precedent. See, for example, the numerous Supreme Court decisions establishing the legality of Roe v. Wade. There would really be little need for a hearing if every judge could be expected to rule the same way on such issues. I’m somewhat disappointed that Judge Sotomayor backed away from her out of court remarks to the effect that a female Latina judge could decide some things better than a white male judge. She will certainly see things from a different perspective, and sometimes a more humane perspective. It seems obvious to me that this is likely in some situations — say in the case of the thirteen year old girl who was strip-searched by her high school administrators because she was suspected of drug dealing, or in cases such as white males bringing charges of "reverse discrimination." As she told the Senate Judicial Committee, she is no automaton. She brings to every case her experience as a young impoverished girl growing up in public housing. No other judge has both experiences.
The Republicans accused her of compassion and sympathy, which seem to me to be virtues rather than vices — particularly when it comes to the law. The issue is not whether a judge should ignore her experience or identify with those who share it; it is rather that she should not let her ideological bias blind her to close scrutiny of the issues.
Few conservatives object when corporations decide to establish their legal headquarters in Delaware because Delaware courts understand — shall we even say, are sympathetic toward — corporations. For many decades corporate law has been refined in Delaware by the interests of corporations. Precedents have been established over the years that make it desirable to have their cases tried in Delaware courts.
One of the most egregious precedents established nationwide is the legal definition of a corporation as a person, thus granting it the right of free speech and protecting its ability to buy — through legal donations — representatives at all levels of government that are perceived to be sympathetic to its cause. Everyone knows that we have the best government money can buy, and this discouraging fact was made possible by legal precedent. When you have wealth and power, you don’t have to break the law, you can change it to suit your needs. The Supreme Court as presently constituted has considerable experience in corporate litigation. This corporate bias was increased by the two most recent conservative appointments under President George W. Bush. A nation that is truly "of the people, by the people and for the people" has yet to arrive on this earth — although we have made pretensions in that direction for over two centuries, and in our best moments, we go a long way toward realizing it.
Like it or not, the "law in its majesty" is a creation of human minds that see things differently. Judge Sotomayor will bring to the court invaluable experience not only as a lawyer and judge but also as a human being, who because of her gender and upbringing will interpret the law differently from most of her male colleagues — and perhaps also may differ from her female colleague. This is a virtue, not a vice. Democratic law in its finest expression does not depend on value consensus, but rather on vigorous open debate. The legal precedents set by the court will be more humane because they will better reflect the experiences of those who are bound to obey them.
President Barack Obama seems to hold a similar view of the law when he writes in his book, "Dreams from my Father: A Story of Race and Interdependence."
How do we transform mere power into justice, mere sentiment into love? The answers I find in law books don’t always satisfy me — for every Brown v. Board of education I find a score of cases where conscience is sacrificed to expedience and greed. And yet, in the conversation itself, in the joining of voices, I find myself modestly encouraged, believing that so long as the questions are still being asked, what binds us together might somehow, ultimately, prevail.
The fundamental problem behind ultra conservative thought is the certainty that the law that has been enacted by the courts is sacrosanct — except in those cases where the law goes against its interest. Then conservatives will also call for change. If Judge Sotomayor is confirmed, she will be the third female in history to serve on the court and the first Hispanic. That the court has been so dominantly composed of white males is a classic example of a great structural injustice in our society that can only be redressed by the appointment of more female and minority judges.

Because the people that voted for this change, thought they had a FREE ride. Of course the LMSM made a BIG DEAL over Bush admin. tactics hourly. They still blame him for everything. Wait until they wake up and see the TOTAL EROSION of their rights. Bush in retrospect will seem like a benevolent person.

| It sure is a travesty that the major news media does not put this forward. They deliberately cover any negativism of Obama, his choices, his administration, and his policies. Democrats should be just as outraged. Is this the kind of environemnt you chose to live in? A government run media or at least an opverly sympathetic media. Your freedoms are eroding bit by bit and you stand idly by. You we3re quick to shout at the Bush administration for perceived freedoms lost, so why not now?

| Sonia Sotomayor is not just a card carrying member of LaRazza, this woman is on the LaRazza Board of Directors. In that capacity, she sets the agenda. For obvious reasons, Republicans kept away from "The Race" connotations of Sotomayor's affiliation and director position in LaRazza. It's NOT just an organization that sponsors ethnic celebrations of their race. It is a powerful political organization that has as its ultimate goal taking control of towns, cities, states, and eventually this country. Getting Sonia Sotomayor on the US Supreme Court is a next important step in that direction. She put on a good act during her confirmation - careful not to expose herself and hid behind a constant smile. She won't make decisions as a justice and NOT be biased by her ethnicity - she was a LaRazza director!

So soon, without any doubt, we’ll have a new SCOTUS Justice in Judge Sotomayor. She wioll be confirmed without a hitch despite a couple of hitches. The one that sticks in my craw is her membership in LaRaza. She’ll be confirmed with the approval of a large number of Americans. That's because they know that if average Americans knew the truth about La Raza they would reject out of hand La Raza's arguments in favor of amnesty and "comprehensive immigration reform!"
Since you, like me, (communists, socialists, liberals and other assorted leftists excepted) are deeply concerned about the battle to secure our borders, enforce our laws against illegal immigration and preserve our national identity, I'm sure you're very familiar with La Raza (English translation, "The Race").
La Raza is a leading national advocacy group for:
· Driver's licenses for illegal aliens;
· In-state tuition benefits for illegal aliens;
· Social Security benefits for illegal aliens who work in the "informal sectors of the labor market;"
· Eligibility for illegal aliens to participate in the new universal health care plan now being developed;
· And of course, amnesty for illegal aliens.
La Raza is also a powerful voice in Washington and around the nation against:
· Building the congressionally-mandated fence along our border with Mexico;
· E-verify programs, which they say discriminates against Latino workers;
· And immigration laws at the state level.
Now let me share with you some facts that you might not know (or care) about La Raza:
· La Raza sits on over $100 million in assets; if you add in the wealth of its subsidiary organizations, the total exceeds $150 million;
· The power and impact of La Raza has been bolstered by massive contributions from financial institutions that are now either fully owned or sustained on taxpayer funds through the "TARP," including Fannie Mae, Freddie Mac, Citibank and Wachovia;
· La Raza has received $950,000 in funds through the Obama economic "stimulus" plan;
· Overall, La Raza has received more than $22 million in taxpayer funds directly from the federal government;
· And La Raza's "Democracia USA" Project has been accused of serious voter fraud in the 2008 elections!
La Raza is a hugely influential lobbying force in Washington and in the Obama administration (La Raza's senior vice president, Cecelia Munoz, received an "ethics waiver" in order to get around President Obama's rules against hiring lobbyists, in order to accept the same President Obama's appointment as Director Intergovernmental Affairs at the White House!)
La Raza also flirts with groups and individuals that are profoundly racist and anti-American.
In 1994, for example, La Raza awarded its Chicano Hero of the Year award to Jose Angel Gutierrez, who once said "We have got to eliminate the gringo, and what I mean by that is that if the worse comes to the worst, we have got to kill him," and "Our devil has pale skin and blue eyes."
And La Raza has endorsed the radical student group MEcha (Movimiento Estudiantil Chicano de Aztlan). "Aztlan" is the radical separatists' name for the southwestern United States, which groups like MEcha want to see incorporated into Mexico.
MEcha's slogan in English is "Everything for the race. Everything outside the race, nothing." La Raza's support for MEcha extended to funding the MEcha chapter at Washington DC's Georgetown University.
The fact is that La Raza is radical; it supports efforts to weaken the central role of English as our national language; it opposes all serious attempts at border control; it opposes all serious attempts at keeping illegal aliens out of the American workforce; and it supports groups and individuals who are committed to the dismemberment of the United States of America!
Yet the mainstream media, the Obama administration and most members of Congress treat La Raza and its spokesmen as if they represented some benign Hispanic version of your local Kiwanis Club!
I suspected that Judge Sotomayor's membership in La Raza would be either ignored during her confirmation hearings, or at best mentioned in passing by one of the members of the Senate Judiciary Committee.
Far worse, with the Obama administration and the Democrats in their debt for their massive financial support and (questionable) voter registration efforts in the 2008 election cycle, La Raza is prepared to wield a powerful influence in the shaping of the new "comprehensive immigration reform" (amnesty) bill. Here’s more change you can believe in.

We are about to see a real railroading job done as Sonia Sotomajor takes a seat on the the Chief Justice John Roberts led US Supreme Court. President Obama has called for a replacement supreme court justice endowed with a sense of "empathy."
Obama got it completely, or at least half way wrong! Justice, or the finding of innocence or guilt, is not a function of being empathetic for the accused person or group. Justice is not "blinded" while applying empathy. In deciding guilt or innocense there is no "gray area" (no in-between shade). Applying empathy is shading the truth one way - towards the victim or towards the accused in deciding a virdict by the sitting judge(s).
Once the acused is found guilty, then and only then, should the judge's empathy come to bear on the case and sentence given. Empathy is based on "mitigating circumstances" which are never considered during the adjudication process - innocent or guilty.
Sotomajor has demonstrated she can't keep empathy and justice separate because of her ethnic background and overriding gender empathies. Some would say her liberal position (views) on guilt and innocense will shade her decisions. When she summarily ruled on the case as "non-contende" between white's against reverse discrimination, she revealed her empathies - to her, white firemen had no case! It wasn't blind justice Sotomajor had practiced. It was empathy driven corruption.
