Please give me the website address to my cttp on when I said I put up my fence due to rocks. I must of miss looked something. My fence was up way before the recall and was in the photo's taken of my trailer 18 months back. The fence was put up to have a hand in protecting my family and land. If you would like to get personal on the issues at hand please do give me a call. I would more then happy to give you full details.

I personally counldn't care less about your fence but you publicly stated you put the fence up because someone was throwing rocks at your windshield..

I'm may be wrong but isn't a multi family home considered commercial? Maybe that's the difference within the code.

Jeff with all due respect a multi family house on land can have a 8 foot fence. Emergency or not people have gates that can be cut if need be.

Can we disagree with the city and not be called Shannon?

I have lived here in Apache Junction  for 13 years, I have first hand knowledge that there is coruption in the city.  Just do or say something against the city and you'll find out.  I was very involed  with the city and politics years ago  and because of some people who run this city i lost my business. I'm not looking for pitty or to be called names, but in seems like if someone doesnt agree with you they are called Shannon or wrost. Not everyone will agree with you and your ideas about the city. I for one would like to see all new people in there but we need to find the right people to run and that seems to be just a dream.

Shannon fench may be illegal but i have seen the city go after one person and not others with the same violation. Why do they go after some and not everyone? and you still think there is no coruption?

The same thing happened with Rita Ulshiemer. She had an annonymous neighbor with an ax to grind, yet code compliance had to pass numerous citizens with the same violation to get to her house...

Where I grew up we didn't have fences everyone knew where the property line was but we were also much more "neighborly".     I'm not used to this "turn my neighbor in" mentality.

Well CR,

 These people with axes to grind would make great Nazi or Stasi informants back in the day.   Why is an 8 foot fence legal for a duplex while a 6 feet fence is too high for the front of a single family home?    These are arbitrary and capricious ordinances

and I hope  that they are reversed.   This is not about my situation only.  I hope that

the council doesn't pass any foolish ordinances on horse properties either.   How

about a limit on cats per household as well?

Ajbizowner - my sympathies go out to you for losing your mare.  It always tugs at my heartstrings to hear that anyone has lost a horse for any reason.  God knows, I have lost a few in my lifetime, also.  I wasn't trying to imply that I knew about all horses here in the West, I just know about my own horses.  Peace and harmony to you and with that, I'll just shut up also.

Yes I did read it Katy,

I never meant to say fences made people "unfriendly", I was just pointing out where I grew up. I agree they have their purpose as here I have one to keep my animals secure.

I'm going to make a guess at this ordinance as I haven't read it yet.  I'm thinking the Flynns fence (really I couldn't care less about) is directly in the front yard whereas yours being 40' back from the property line may be considered no longer the front yard..

It obviously makes a difference 40' from the middle of the street or 40' from the property line

Just a guess either way my point was  why make trouble with neighbors anyway, we have to live with one another.  I prefer to live in peace :)

Katy,

I wasn't throwing jabs- I lost my beautiful Bask++ Arabian mare because something chased her THROUGH a fence and she died from the stress and injuries. I would give anything to undo time and make that fence short enough for her to have jumped!

Since you know all about horses here in the west, I'll just shut up.

A horse might not go OVER a 6' fence, but if they've been spooked badly enough, they could go THROUGH one, especially a so-called "transparent" chain link fence!

However, you're missing the point. Shannon doesn't have a horse to worry about, just an illegal 6' fence. She says they put the fence up to keep people from throwing rocks at their cars. If that was the problem, why didn't she ask her friend then-Chief Walp for help? Maybe HE advised her to put up a higher fence?

Not necessarily... if the laws were different when that fence was constructed (laws allowed 6-foot fence at edge of ROW) or no laws regarding the height of fences existed... then the fence should be grandfathered.

changes to city ordinances are not usually retroactive... for good reason.





I thought grandfathering only applied to the orignal owner..?

MikeW - Oh, yes, the horse farms in Kentucky and Tennessee are absolutely beautiful with their nice board fences and their lush green pastures.  And we had that kind of environment where we lived before moving our horses here to Arizona.  We were actually advised against a board fence here because of the termites and the heat. Our decision to put in a 6'  chain link fence was purely a personal one based on our circumstances.  If you've ever had a horse get off your property, whether they jumped a fence or some other reason, you would know that it can be a pretty scary scenario.  And there have been horses get off properties in my neighborhood from time to time.  I doubt these were reported to the police - the owners simply rounded them up and put them back in their enclosures.  My 6' fence just gives me the added peace of mind that I don't have to worry about my animals getting out.  And yes, you are correct about the property line starting at the middle of the road.  Please excuse me, I used the wrong terminology - sorry, didn't mean to confuse anyone.  My fence is 40' in from where the city easement ends ( or 40' in from my survey stakes.)

Not necessarily... if the laws were different when that fence was constructed (laws allowed 6-foot fence at edge of ROW) or no laws regarding the height of fences existed... then the fence should be grandfathered.

You should drive through Kentucky, three board fences is just about all you see. Please check with the PD to see if there have been any horses that jumped a 4' 6" fence and were wandering the streets. I don't doubt you, just a question. Also the property line starts at the center point of the road, everyone gives the city an easment for roads.

Christa - with all due respect, if you will read my earlier post, the City of Apache Junction told me I could have a 6' fence along the front of my property but in order to do this, it had to be set back in 40' from the property line.  A fence that is right on the front property line can only be 4 1/2' tall.  Also, as I said earlier, the purpose for my installing my chain link fence is to keep my horses from wandering out onto the roadway and causing an accident.  My fence does not detract from my friendliness towards my neighbors.  They all understand why my fence is there.  I also agree with you that where I grew up, we didn't need fences, either.  We weren't allowed to have horses in town and the only fences that were needed were the small ones to keep the dogs in the back yard.

Personally I don't care about Shannons fence. If she's in violation it's no ones business but hers. However I have never seen a city allow a 6' fence in a front yard.

The same thing happened with Rita Ulshiemer. She had an annonymous neighbor with an ax to grind, yet code compliance had to pass numerous citizens with the same violation to get to her house...

Where I grew up we didn't have fences everyone knew where the property line was but we were also much more "neighborly".     I'm not used to this "turn my neighbor in" mentality. 

 Why start a war with someone you have to live with...

I'll admit there is the possibility they constructed the fence without pulling the appropriate permits... kind of risky considering that it would be difficult to hide the fact that you are constructing an "illegal" fence.

Did they get approved permits???

Otherwise, I was considering the possibility that they bought the property with the "illegal" fence already built by a previous owner.

Just seeking out all the facts before passing judgment.
